Please read these Terms & Conditions (“Terms”) carefully before booking a safari with Magic Wildlife Safaris (“we,” “us,” “our”). By making a booking, you (“the client,” “you”) agree to be bound by these Terms.

1. Booking and Payment

  • Confirmation: A booking is considered confirmed only upon our receipt of a non-refundable deposit of 30% of the total safari cost.
  • Final Payment: The final balance is due no later than 60 days prior to the safari departure date.
  • Late Payment: If the final balance is not received by the due date, we reserve the right to treat the booking as canceled and apply the cancellation charges outlined below.
  • Payment Methods: Payments can be made via bank transfer or credit card. Please note that credit card payments may incur a processing fee.

2. Cancellation Policy

All cancellations must be made in writing and will be effective on the date we receive them.

  • Cancellation by You (the Client):

  • Cancellation 91 days or more before departure: Loss of the non-refundable deposit.
  • Cancellation between 61-90 days before departure: 50% of the total safari cost is non-refundable.
  • Cancellation between 31-60 days before departure: 75% of the total safari cost is non-refundable.
  • Cancellation 30 days or less before departure, or a no-show: 100% of the total safari cost is non-refundable.

We strongly recommend that all clients purchase comprehensive travel insurance at the time of booking to cover cancellation fees and other unforeseen events.

  • Cancellation by Us (Magic Wildlife Safaris):

We reserve the right to cancel any safari due to force majeure (e.g., natural disasters, political instability, pandemics) or insufficient participant numbers. In the event of a cancellation by us, we will offer you the choice of:

  1. A full refund of all monies paid to us.
  2. An alternative safari of a comparable standard, if available.

We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.

3. Travel Insurance

It is a condition of booking that all clients have comprehensive travel insurance that is valid from the date of deposit until the conclusion of the safari. This insurance must cover, at a minimum: cancellation and curtailment, medical expenses, emergency evacuation (including air ambulance), personal baggage, and personal liability. Proof of insurance may be required prior to departure.

4. Itinerary Changes

While we will make every effort to adhere to the planned itinerary, we reserve the right to make changes due to local conditions, weather, or other unforeseen circumstances for the safety and well-being of our clients. In such events, we will provide the best possible alternative. Any additional expenses incurred as a result of these changes will be the client’s responsibility.

5. Passports, Visas, and Health

It is the client’s sole responsibility to ensure that they have:

  • A valid passport with at least six months of validity from the date of return.
  • All necessary visas, permits, and certificates for the countries to be visited.
  • All required vaccinations have been taken, and necessary health precautions have been taken.

We can provide general advice, but we are not liable for any client being denied entry or travel due to a failure to meet these requirements.

6. Liability

Magic Wildlife Safaris acts only as an agent for hotels, safari lodges, airlines, restaurants, and other contractors that provide services to the client.

  • All bookings are accepted on the express condition that we are not liable for any injury, damage, loss, accident, delay, or irregularity which may be occasioned either by reason of any defect in any vehicle or through the acts or defaults of any company or person engaged in conveying the passenger or in carrying out the arrangements of the tour.
  • Wildlife viewing is inherently risky. While our guides are highly trained, we are not responsible for any injury or incident caused by wildlife. By booking with us, you acknowledge and accept the risks associated with adventure travel in Africa.

7. Client Responsibility

The client agrees to accept the authority and decisions of our employees, tour leaders, and agents while on safari. If, in the opinion of such a person, the health or conduct of a client at any time appears likely to endanger the safety, comfort, or happy progress of a safari, the client may be excluded from all or part of the tour without refund or compensation.

8. Photography and Marketing

We reserve the right to take photographs and videos during our safaris. By booking with us, you grant us a perpetual, royalty-free, worldwide, irrevocable license to use any resulting images or footage for promotional and marketing purposes (e.g., on our website, social media, and in brochures) without any compensation to you. If you do not wish for your image to be used, you must inform us in writing before your departure date.

9. Complaints

If you have a complaint about any of the safari arrangements, you must bring it to the attention of our local representative or your guide at the time so that they may endeavor to rectify the situation. Should the problem not be resolved, you must submit your complaint to us in writing within 28 days of the completion of your safari.

10. Governing Law

These Terms & Conditions and any contract to which they apply are governed in all respects by the laws of Uganda. Any dispute will be subject to the exclusive jurisdiction of the courts of Uganda.

11. Acceptance of Terms

Payment of the deposit or the final balance for a safari constitutes the client’s full acceptance of these Terms & Conditions.
